Il explique le choix de ce nom :

"Aux Etats-Unis, bien qu'au tribunal tu sois toujours présumé innocent avant d'être déclaré coupable, généralement, si tu es Noir, tu n'es pas forcément coupable mais tu es certainement un criminel innocent — tu es suspect.
The Innocent Criminals n'est pas un groupe de fouteurs de merde qui dit "fuck the police". Nous n'avons pas cette approche là."

Juan Nelson donne son avis sur le nom du groupe :

"C'est Ben qui a trouvé ce nom de Innocent Criminals. C'est original, ça me plaît bien. Je m'y identifie en tant que Noir américain. D'où je viens, c'est être vu par les autorités comme coupable avant même que... vous me suivez... je n'aime pas trop dire ça, mais c'est vrai. J'ai rien fait ! Je le jure..."
